Welcome to the Creatify application and related services (the “App” or “Service”) operated by Techbot Co., Limited (“we”, “us”, or “our”).
These Terms of Service and End User License Agreement (“Terms”) form a legally binding agreement between you and Techbot Co., Limited and govern your access to and use of the App and related services.
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, you must stop using the App immediately.
The App provides AI-powered features that allow users to generate photos or videos based on images selected by the user.
When you use AI generation features:
Only the specific images that you select are transmitted to our servers and trusted cloud service providers, such as Amazon Web Services, for processing.
Images are processed solely for the purpose of generating the requested output.
Images are not used for advertising, profiling, biometric identification, or artificial intelligence model training.
Images are processed temporarily on secure servers and are permanently deleted after processing is completed.
Subject to your compliance with these Terms, Techbot Co., Limited grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the App on devices that you own or control, solely for your personal and lawful use and in accordance with these Terms and applicable law.
This license does not transfer ownership of the App to you. The App is licensed, not sold.
You agree not to:
(a) Copy, modify, distribute, sell, lease, sublicense, or reverse engineer any portion of the App except as expressly permitted by applicable law or these Terms;
(b) Use the App for any unlawful, harmful, abusive, fraudulent, or misleading purpose;
(c) Attempt to gain unauthorized access to any systems, networks, or data connected to the App;
(d) Interfere with or disrupt the integrity, security, or performance of the App or related services.
All rights not expressly granted to you are reserved by Techbot Co., Limited.
The App and all related content, features, and functionality—including software, designs, text, graphics, images, audio, and trademarks—are owned by or licensed to Techbot Co., Limited and are protected by applicable intellectual property laws.
Nothing in these Terms grants you any right to use our company name, trademarks, logos, or other brand assets without our prior written permission.
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, store, and protect personal information.
Please review the Privacy Policy carefully before using the App.
Certain features of the App allow you to submit, upload, or otherwise provide content, including images and videos (“User Content”).
You retain ownership of your User Content.
By submitting User Content, you grant Techbot Co., Limited a limited, non-exclusive, worldwide license to host, store, transmit, process, and display such User Content solely for the purpose of providing, operating, maintaining, and improving the Service.
User Content may be processed using cloud infrastructure and artificial intelligence technologies as described in the Privacy Policy.
We do not sell, license, or commercially exploit User Content.
You are responsible for ensuring that your User Content complies with applicable laws and does not infringe or violate any third-party rights.
The App is provided on an “as is” and “as available” basis.
We may update, modify, suspend, or discontinue the App or any part of the Service at any time, including to improve functionality, maintain security, or comply with legal requirements.
We do not guarantee that the App will always be available, uninterrupted, or error-free.
While we aim to provide a stable and reliable experience, we do not warrant that the App will meet all user expectations or operate without interruption or defects.
We are not responsible for interruptions or failures caused by circumstances beyond our reasonable control, including network conditions, device limitations, third-party service issues, or force majeure events.
To the maximum extent permitted by applicable law, Techbot Co., Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your access to or use of the App.
Nothing in these Terms limits liability to the extent such limitation is prohibited by law.
We may revise these Terms from time to time.
If we make changes, the updated Terms will be made available within the App or on our website.
Your continued use of the App after the updated Terms take effect constitutes your acceptance of the revised Terms.
These Terms are governed by applicable laws, without regard to conflict of law principles.
